City amends rent ordinance section contingent on Costa-Hawkins

Rent Ordinance Section 37.3 has been amended, with the changes taking effect on November 24, 2024. The modifications, under Ordinance No. 248-24, involve altering the new construction date in the Rent Ordinance. This change is contingent upon the repeal or amendment of Costa-Hawkins to allow such an adjustment by the City.

Should Costa-Hawkins be repealed or amended in the future, the new construction date will automatically update to reflect the most recent date permitted by State law, extending up to June 13, 1994. Consequently, units built between June 14, 1979 and potentially up to June 13, 1994 would no longer be exempt from rent control based on their construction date unless another exemption applies.

Currently, without any changes to Costa-Hawkins, the new construction date in the Rent Ordinance remains unchanged. Additionally, amendments to Section 37.3 include non-substantive revisions intended to clarify existing laws regarding when condominiums are exempt from rent control.
